Reporting content that infringes your copyright

We respect copyright and expect users to do the same. If you believe something in The Dive App or on the-dive-app.com infringes your copyright, send a written notice to our designated agent containing:

  • your physical or electronic signature;
  • identification of the copyrighted work you believe is infringed;
  • identification of the material you believe is infringing, and where it appears (for example, the dive site and photo or comment);
  • your name, address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

Designated agent

POSEIDON DYNAMIC SOLUTIONS LLC, Attn: Copyright Agent, 7901 4th Street N, Suite 300, St. Petersburg, FL 33702, USA — hello@the-dive-app.com

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same agent with your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your name, address and telephone number, and your consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any judicial district in which we may be found). We may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complaining party tells us it has filed a court action.

Repeat infringers

We remove infringing material and disable the accounts of users who repeatedly infringe others' copyrights.
